Introduction

Many people have opposing views on how the drug problem should be tackled, with the epicentre of any debate focusing on two differing solutions to tackle the problem. These two solutions consist of imposing a sanction such as prison, or tackling the problem from a different angle by offering probation to an offender coupled with drug treatment programs. This article will assess to the effectiveness of the two systems. Firstly, the drug crisis and its effects on society will be examined. Following from this will be an assessment of each of the systems, focusing upon there effectiveness. Finally, some alternatives will be advocated that depart from the present system. After assessing all of the evidence available, the conclusion that will be reached is that if society is to curtail the exponential rise in drug abuse, a far more informative system must be implemented, before another generation is lost to drug abuse.

The Drug Conundrum

Drugs have been around in some form or another since 4000BC (Egyptians with wine and marijuana used for medicinal purposes in China). Although drugs were widely used, it was not until the 19th century that the active substances in drugs were extracted and used as a lifestyle choice.

The addictive nature of drugs was immediately apparent, although there was a gradual recognition of this property with the passing of the first national drug law, the Pure Food and Drug Act of 1906. The destructive nature of alcohol in society led to the prohibition period in America. Therefore, the drug problem has been around, and more importantly, been acknowledged for some time.

The experimentation period of the 1960’s had a profound effect on society. The ethos was love, drugs, social ideological rebellion, more drugs, and then more drugs. The administration was rocked to its very foundations, which culminated in far more draconian police force. Whether proliferation in state interference was inevitable, a position advocated by Orwell, or whether it was a result of drug taking, one can only surmise. Nevertheless, the position is conclusive, drugs have had a significant effect on society. How society has chosen to deal with this crisis will now be examined.

The Threat of Prison as a Deterrent for drug Use

For an addict, the threat of prison is about as effective as a chocolate teapot in the desert. It relies on the premise that the addiction is controllable. This provisional period can entail many things for a convicted drug user, with impositions such as involuntary drug programmes and drug testing.

Involuntary drug programmes can entail taking substitute drugs to wean a person off a specific drug, resulting in a lower dependency and a reduced level of tolerance. The problems that can emanate form these programs consist of a lack of secondary support for drug users. This can result in an individual being drawn back into a cyclic situation which ultimately results in that individual taking the very drugs that the substitute drug was supposed replace. Involuntary drug tests emanated from America and involve a person being requested to take a drug test within a specific period of time. If the person tests positive, then the suspended sentence is then imposed, these will often lead to a custodial sentence.

Whilst the two systems do have their own merits, it is possible to adduce from these two alternatives a far from satisfactory conclusion. Both systems rely heavily on the circumstances that the drug user finds themselves in once the probation period has been imposed. Those who have funded their habit through criminal activities will often have a criminal record, and thus will be unable to find employment. They will often still exist in the very same peer groups where the original problems emanated, therefore, there must be a more viable solution to this drug quandary.

A Possible Alternative

The buzz word at this present moment in time is decriminalisation. Decriminalisation, in its most severe form would involve a complete removal of all criminal sanctions that are currently imposed for drug use. This would then remove drug users from the criminal process and would focus attention on treatment. There is staunch opposition to this concept in some quarters as people believe that it would create an environment for experimentation and lead to an exponential rise in drug taking. Advocates for decriminalisation point to alcohol as an example of a drug that, under correct supervision, can be controlled.

Conclusion

Any problem that involves an addiction will never be able to be tackled by easy solutions. This article has, however, highlighted to difficulties that society faces if it wishes to address this problem in organised concerted fashion. There is, however, a realisation that the draconian legislative measures, that have been, as of today, highly ineffective, being replaced with more suitable measures of tackling the drug issue. Our system of justice is known as an “adversary system.” This is the nature of the beast. It began hundreds of years ago in the middle ages with “trial by combat,” where people with a disagreement would fight it out and whoever survived was “right.” Today, physical contact is no longer a recognized legal technique, but things are still set up as a fight. The parties are regarded as adversaries, enemies in combat. When a divorce is conducted in our legal system, the spouses and their attorneys are expected to struggle against one another and try to “win” the case, to “beat” the opposition.



The rules control the way your attorney works with you. Your attorney is required to be “adversarial,” that is, aggressive and combative. The adversary system and the way lawyers work in it is a major cause of conflict, trouble and the high cost of divorce. You want to have as little as possible to do with the legal system. It is designed to work against you.



In spite of the way things seem, lawyers are not always villains and not always to blame for stirring up conflict. But even for lawyers who mean well, the tools they use and the system they work in will usually increase conflict. Law schools do not require courses in communication or negotiation. Rather, they stress manipulation of rules of law, aggressive and defensive strategy, how to take any side of any case and make the most of it, how to argue, and how to get the most financial advantage in every situation.



Professional standards of practice dictate how a lawyer will conduct your case. For example, professional ethics forbid your lawyer to communicate directly with your spouse–the adversary. It is expected, instead, that your spouse will be represented by an attorney and your lawyer can only communicate through your spouse’s lawyer.



This means that your attorney can’t “talk sense” to your spouse, or explain to your spouse how you see things, or even help you talk to each other. It means your attorney will always have a one-sided view of your case and can never achieve an understanding any greater than your own.



If you retain a lawyer, he will definitely take your case into the contested cycle of the legal system because that’s the only thing he can do. He has to. There are no other formal tools a lawyer can use.



The primary tools the lawyer uses are pre-trial motions and discovery. An attorney can take you and your spouse into court to get temporary orders for support, custody, visitation or keeping the peace. An attorney can use formal discovery to get documents and information under oath.



So, if you and your spouse can work out your own temporary arrangements and share all information openly, you’ll have no need for those incredibly expensive legal tools. You can keep your case out of lawyers’ offices and out of court.



But, if either spouse retains an attorney, that attorney will invariably write formal letters, file legal papers, make motions, and do discovery. These actions will surely cause the other spouse to get an attorney, too. Now, instead of two people who don’t communicate well, you have four people who do not communicate well. The case is now contested and the cost and conflict level will go way up. Attorneys tend to ask for more than they expect to get; it’s considered “good” practice. Your spouse’s lawyer will oppose your lawyer’s exaggerated demands by offering less than they are willing to give and by attacking you and your case at the weakest points.



Now you’re off to a good, hot start and soon you’ll have a hotly contested case, lots of cost, and a couple of very upset spouses. Fees in contested cases can run from tens of thousands of dollars each all the way up to everything.



Summary: Except in high-conflict cases, the legal system has little to offer. The things an attorney can do for you are expensive, upsetting, and tend to increase conflict rather than reduce it.

It is not uncommon for divorcing people to do things like spend $500 to get a $100 microwave oven. Don’t do it. If you can’t see a clear connection between your actions and achieving a final resolution of your case, then don’t take that action.

Other ways to minimize legal fees. Holding legal fees down should not be carried out in such a way that you become penny-wise and pound-foolish. Don’t, for example, rely on your spouse’s lawyer to do all the work. Opposing counsel is not safeguarding your interests, of that you can be certain. You can lower your own legal fees however, if your lawyer charges on an hourly basis, by avoiding long-winded telephone conversations and unnecessarily long meetings with your attorney, by doing lots of the document “homework” on your own, by taking as reasonable a position as possible in negotiations, and by steering clear of protracted litigation.
